General Terms and Conditions for Holiday and Vacation Rentals and Reservations
The general booking and rental conditions form an integral part of the rental contract between the client and Random Alicante SL and therefore the signing of the same implies the acceptance of each and every one of its conditions. The fact of making a rental request by means of any medium, e-mails, web portals for tourist or other types of advertisements, the company’s web page, or directly at the offices of Random Alicante SL, also implies the acceptance of the general and specific conditions of each accommodation. Raidom Alicante SL acts as agent for the owner of each rented property for the duration of the lease.
- Contracting and payment conditions.
The reservation and contract is made to final consumers, declining any responsibility for prejudices derived from loss of business benefits. The reservation of the rental can be made via the Internet. The requesting Client (name of the company) will be asked for information that must be completed with personal data (name, surname, ID card number, address). If this is your first booking, it will only be validated once the customer has paid 100% of the rental (See Special Conditions.) You will receive a confirmation of your booking by email. The payment method will be via the online platform, with its payment options.
The customer will have the option to choose between the two refundable and non-refundable rates. If the client chooses the refundable rate, he/she will be able to cancel free of charge up to 30 days before arrival. If the client chooses the non-refundable rate he/she will have a 10% discount but in case of cancellation he/she will pay 100% of the reservation. However, it is always possible to cancel the booking free of charge within the first 24 hours.
In case of non-compliance with the required deadlines and conditions, the booking may be cancelled automatically and without notice.
- Prices and services provided.
The published prices for flats are per day (but there may be exceptions). The minimum stay is one night (Raidom Alicante SL) reserves the right to modify prices without prior notice. However, reservations must be made 24 hours in advance, so that the flat can be prepared in time.
The prices include the provision of the fully equipped accommodation, all the charges inherent to the house, maintenance, and cleaning. Included in the price are taxes and tourist taxes that will be applied according to the law depending on the number of people and nights.
The prices include everything: heating or air conditioning, cot, high chair, etc. Everything that is available in each of the houses, and that is indicated on the web.
- Guarantee deposit.
A deposit is required depending on the accommodation. This deposit is used as a guarantee of the good use, conservation of the furniture, equipment, and conditions of use and departure. This amount will be paid by bank transfer or in cash on the day of arrival. The security deposit will be returned by bank transfer to the account indicated by the tenant within a maximum period of 7 days. The security deposit does not exempt the client from being liable for damages in excess of this deposit in the event of serious negligence and deterioration due to misuse and vandalism. If the amount of repair of the damage exceeds the amount deposited as security deposit, it will give rise to a claim for the difference through the corresponding legal channels.
- Handover of keys.
The accommodation is available from 15:00 until 24:00, and we have the option of self check-in.
And the check-out time until 11:00 am.
- Conditions of use.
The number of people per accommodation cannot exceed the capacity indicated in the rental conditions of each flat, not even during the stay. Pets are only allowed if this is expressly stated in the rental contract or in your reservation.
The customer is responsible for the care of the property. The use of the property is for the holiday home of your family and companions, and not as a permanent residence. The use of the property may not be changed, the property may not be used for any kind of business, nor may it be sublet, nor may it be used for unhealthy or dangerous activities, or activities that may pose a danger or nuisance to neighbours. The Lessee waives the rights contained in articles 31 to 33 of the Urban Leases Act, and therefore the rights of subletting, subrogation, assignment, or transfer, whether in whole or in part, first refusal, pre-emption and the right to challenge the transfer. Once the stay has started, neither Random Alicante SL , nor the owner will be held responsible if the client/tenant decides to leave before the end of his/her stay. No refunds will be made. The client is obliged to respect the community rules and Random Alicante SL reserves the right to cancel or cancel the rental in case of reasonable doubt about the possibility of causing serious damage to the property. Failure to comply with the conditions of use and/or departure will lead to the automatic cancellation of the contract and the loss of the money invested in the rental. (See particular conditions).
- Alternative or cancellation of the contract.
Raidom Alicante SL, reserves the right to substitute the booked accommodation for another of similar characteristics in the case of serious unforeseen circumstances. In the case of force majeure Raidom Alicante SL, may cancel the contract by refunding the total amount paid.
- Cancellation of reservation.
In the event of cancellation of reservations, once notification has been received, Random Alicante SL offers two rates, one refundable and the other non-refundable. Therefore, only if you choose the refundable rate, you will have the option to cancel without cost up to 30 days before your arrival.
On the other hand, if you choose the non-refundable rate, the client will have a 10% discount but in case of cancellation, he/she will pay 100% of the reservation. But you will always be able to cancel the reservation without cost within the first 24 hours after the process is completed.
- Services and responsibilities.
The owner or Raidom Alicante SL, as intermediary of the service, cannot be held responsible for possible modifications affecting the accommodation or its surroundings, noise, building works, power cuts, nor for negligence or omission of services attributable to third parties, nor for cases of force majeure or unforeseen mishaps for which Random Alicante SL can be held responsible. The owner of the accommodation and Random Alicante SL are not responsible for any damage or harm (injury, illness, death, material damage or theft) suffered by the client or his or her companions, being their sole responsibility and they must therefore ensure their safety and that of their belongings. Random Alicante SL, which is the owner, accepts no responsibility for damages caused by third parties or to other people during the stay. The use of the swimming pool and all the facilities of the accommodation will be under the responsibility of the client/tenant and their companions, the client being responsible and exempting the property and Random Alicante SL from all responsibility. The tenant will be responsible for the keys and personalised security codes that are given to him/her and may under no circumstances communicate them or lend them to third parties outside his/her group of companions.
Each accommodation is covered by a home insurance by the owner that covers their belongings and the property, in no case the belongings of the Client/Tenant. The Client/Tenant is obliged to take out third party liability insurance.
- Collection of keys and departures
The keys will be collected at the address, on the dates and at the times indicated in the reservation. In the event of arriving outside these times, on a holiday or Sunday, you must contact the reception company to coordinate the delivery of the keys. Departures will be made before 12:00 a.m. and in the same state in which it was found, tidy and free of rubbish.
If this is not the case, a supplement will be charged or, in serious cases, the deposit will be forfeited (see special conditions).
We do our best to ensure you have a happy holiday. However, we are open to any complaint or suggestion you may wish to make and we will give you a prompt and satisfactory solution. We advise you to report any incident immediately to Raidom Alicante SL so that we can solve the problem as soon as possible. Some deficiencies (operation of certain facilities, for example) can only be detected after your arrival so please check the proper functioning of the same and report any incident.
- Data protection.
In accordance with the RGPD EU 679-2016, on behalf of Random Alicante S.L. we process the information you provide us with in order to provide you with REAL ESTATE AND AUXILIARY services, together with the corresponding administrative work. The data provided will be kept for as long as the business relationship is maintained or for the years necessary to comply with legal obligations. The data will not be transferred to third parties except in cases where there is a legal obligation. You may at any time exercise your rights of access, rectification, deletion (right to be forgotten), limitation of processing, data portability, opposition and the right not to be subject to automated decisions, by writing to the following address: Random Alicante SL with registered office at Calle Malta 74 bj 73, 03130 Santa Pola, CIF B42569798.
- Validity and place of jurisdiction.
The contractual relationship is subject to the arbitration office or courts of the Province of Alicante, Spain.
